Legal Counsel

Our Environmental, Health & Safety Team works with clients in a variety of industries before the Environmental Protection Agency (EPA), the Occupational Safety and Health Administration (OSHA), the Mine Safety and Health Administration (MSHA), the Federal Aviation Administration (FAA), related state agencies, and counties and municipalities. Our lawyers have expertise in a number of specialized areas, such as regulatory compliance; air, waste and water permitting; Brownfields; LEEDs; toxic torts; indoor air quality; hazardous materials; federal Superfund and state cleanup and cost recovery; and transactional matters. In addition, our team includes highly skilled litigators who regularly defend clients in matters before federal and state courts and administrative agencies.

We guide our clients (including multinational companies) through the broad array of environmental, health and safety issues at federal, state and local levels to finalize real estate, corporate and commercial transactions Whether counsel is needed to address complex due diligence or lender liability issues, draft or negotiate environmental contract terms, creatively resolve liability concerns through Brownfields or voluntary cleanup programs, agency comfort letters, site status letters, opinion letters, prospective purchaser protections or environmental liability insurance, our lawyers can assist in every step of the transaction.

EHS Compliance Counsel

Environmental, health and safety regulations can be difficult to understand even for the most sophisticated businesses. With the knowledge of our clients’ businesses and needs, we understand how these regulations impact their operations, and we know the steps our clients should take to ensure compliance and/or to avoid enforcement actions from federal, state and local regulatory agencies, such as environmental audits or compliance management systems, and agency voluntary disclosure programs for penalty reduction. When an enforcement action is initiated, our lawyers interface with regulators on behalf of our clients to defend our clients’ interests vigorously, while seeking practical, prompt and innovative resolution to issues.
